At 1810 hours, a convenience store employee was taking his break in the parking lot of the store. He was seated in his personal car when he noticed two subjects panhandling and using narcotics in the parking lot. The employee told the subjects to leave the property, and a verbal altercation ensued. One of the subjects then threw a rock at the employee’s car window causing it to shatter. This startled the employee as he did not realize what had happened. The subject who threw the rock then said, “I’ll shoot you too.” The subject then walked toward the driver’s side of the employee’s car and the employee armed himself with a firearm that was in the car. The employee exited his vehicle just as the subject made a furtive motion towards his waistband and lunged at the employee. The employee then fired one round at the subject striking him in the abdomen. The subject then ran away to a nearby fast-food restaurant where he collapsed near the drive thru. The employee called 911 and responding officers located the wounded subject shortly after arriving. The subject was transported to HMC, and at the time of this writing is currently in emergency surgery. The employee was cooperative with the investigation and his firearm, and one spent shell casing were recovered and submitted into SPD Evidence. Officers determined that probable cause exists for the crime of felony harassment – threats to kill, for the subject who was shot. It is believed at this time that the store employee acted in self-defense. This incident was screened with SPD Homicide and GVRU.
