On 04-07-2021 at 1614 hours, officers responded to a report of two males fighting in a public park near the King County Courthouse. They found a male on the ground and attempted to assist him, but he refused assistance. While officers were checking on him, he assaulted an officer, calling him racist terms and repeatedly kicking him in the groin and spitting on him. The suspect was handcuffed but continued kicking at and trying to spit on the that same officer, even after a spit sock was applied. Despite this, there was no reportable force used in the arrest. The officer sustained momentary pain but no injuries and needed no medical evaluation. There was no exposure incident either. I initially determined the suspect’s actions were sufficient to book for Inv. of Hate Crime and Inv. of Assault, but after screening and review of the video found the necessary filing standards (for either) were not present. The booking was changed to a single misdemeanor charge of assault.
